What Are Your Options If There Are No Criminal Charges?

Take a recent tragedy in Boulder County for example.  Earlier in the year, a cyclist was traveling down the street, riding safely and cautiously, when he was struck by a truck. The truck suddenly crossed the double-yellow lines, hitting the man on his bicycle. The bicyclist was pronounced dead at the scene.  The driver of the truck was arrested, and even two hours after his arrest, he was found to have a blood alcohol level well over the legal limit.  The driver would go on to confess to drinking beers at a nearby establishment, and empty liquor bottles were found in his vehicle.  There seemed to be no doubt that the man would be facing charges of DUI and vehicular homicide.

But justice has been delayed in the cyclist’s wrongful death.  Doctors at the Colorado Mental Health Institute in Pueblo determined that the driver is not competent to stand trial.  So where does this leave the surviving family?  Reportedly, through medication and nutrition management, doctors may be able to get the man to a place where he’ll be deemed fit to stand trial.  It’s all unclear, and those affected are simply left to wait.
