A spokesman for the Colorado State Patrol related details of a two-vehicle accident in Teller County on Sunday, October 19. Now, a Colorado Springs man faces criminal charges.
Alleged Failure to Stop
The wreck occurred at about 12:50 p.m., at the intersection of County Road 51 and County Road 5, north of U.S. 24. A CSP report indicated that a 20-year-old male was driving a 2012 Nissan Titan that collided with a 1994 Saturn coupe driven by a 35-year-old man.
The report states that the driver of the Nissan pick up allegedly failed to stop at a stop sign as the Saturn’s driver was making a left turn onto County Road 51. After impact, the car came to rest in a grassy area just off the road.
The man that had been driving the Saturn was transported to Penrose Main Hospital where he reportedly succumbed to his injuries within 15 minutes of the ambulance’s arrival at the hospital.
Criminal Charges Result
Although the pick up truck sustained substantial front-end damage, the driver was not injured in the collision. However, as a result of the fatal crash, the driver of the truck was cited for careless driving causing death, according to the CSP spokesman. The charge was originally careless driving causing injury, but it was upgraded after the other motorist died at the hospital.
Although the investigation in this crash is still ongoing, a failure to stop at a stop sign may be cited as evidence of negligent driving. Therefore, in addition to any criminal charges that an allegedly offending motorist may face, a civil suit may be filed as well. State statutes provide survivors of a person that dies allegedly due to the negligence of another individual with the right to seek compensation for loss of companionship, burial expenses, pain and suffering and other potential losses.
