What To Do After an Accident

Motor Insurance Form Stock Photo

The steps you decide to take immediately after an accident can greatly impact your potential claim. Listed below are tips you can follow after an accident:

  • Stay at the scene – It’s imperative to remain at the scene of the accident. If you don’t, you could face criminal penalties. Fleeing an accident is considered a hit and run.
  • Check to see if anyone is injured – The first thing you should do is check if you or anyone else involved in the car wreck has suffered any injuries.
  • Contact emergency responders – If someone is injured, call for help immediately. If not, it’s important to contact the police so you can have a police report filed.
  • Ask for information – It’s important to exchange information with the other driver such as phone number, license plate number, insurance information, and driver’s license number.
  • Take photos of the collision scene – Photos of the wreck can be used as evidence in a claim. Make sure to take pictures from multiple angles and of the other vehicles involved.
  • Contact your insurance company – Even if you’re not at fault, you need to inform your insurance company you have been involved in an accident.
  • Talk with witnesses – If anyone witnessed the wreck, ask what he or she saw. Also, ask for their contact information.
  • Contact our attorneys at Heuser & Heuser – If you or a loved one suffered any type of injuries due to another driver’s negligence, you may be eligible to receive compensation.

Why Should I Hire A Lawyer?

Insurance companies don’t look out for the best interest of the victim and will try to offer a low-ball settlement, which may not cover all of your expenses.

We are familiar with the tactics insurance companies frequently use to get victims to settle for the lowest offer. Our attorneys will not settle for a low offer when you deserve to receive more for your injuries. When you hire one of our attorneys, we will review all the details of your case and determine a reasonable amount of compensation you should receive for your injuries and any damages you experienced.

While every case is unique, our team will see what legal options are available for your case. We will review factors such as medical bills, pain and suffering, and damages to help determine an ideal amount of compensation you rightfully deserve.

He hit a sedan and was ejected from his vehicle. All of the drivers were wearing a seatbelt at the time of the accident. Huffman died at the scene and the driver of the sedan suffered minor injuries.

Construction Site Accident Killed One and Left Two Injured

An accident that occurred on a construction site around Ridge Road and West Pikes Peak Avenue killed one person and injured two.

Construction workers had just cleared that area five minutes prior.” Joseph Quinones was riding in the back seat of the vehicle when the driver crashed into the crane. He later died due to his injuries.

Two others were also injured in the accident, including the driver.

Failure to Use Headlights Caused Car Crash That Injured Two

Driver Rescued by Good Samaritans After Accident

A 28-year-old woman, driving a 2004 GMC Envoy SUV, was traveling near North Carefree Circle and Scenic Circle when she was involved in an accident. The woman was not wearing a seatbelt at the time of the accident and “was partially ejected out of the passenger side window of her SUV.”

Witnesses reported that the vehicle appeared to have landed on the driver’s head. Several good Samaritans lifted the vehicle off of the woman and provided aid until help arrived. She was taken to a hospital and was reported to be in stable condition.

Speed and alcohol are believed to be factors in the accident. The driver received a misdemeanor traffic citation.

Were You Injured in an Accident Involving a Semi-Truck? Contact Our Colorado Springs Truck Accident Lawyers

According to American Trucking Associations (ATA), “Trucks move roughly 71% of the nation’s freight by weight.” Semi-trucks are an essential asset to our economy because they help keep it operating by moving consumer goods and other products. However, these trucks have also caused life-altering damage and injuries to other motorists due to their massive size and weight.

If you or a loved one sustained physical injuries and property damage due to a truck accident, Heuser & Heuser can assist you with your claim. Our Colorado Springs truck accident lawyers have the knowledge and experience to handle these specific cases. We understand that the legal process can be challenging to manage without proper legal advice from an attorney, which is why it’s in your best interest to seek legal guidance immediately after a truck accident.

Truck Accident Statistics

Semi-truck accidents happen more frequently than people realize. The Insurance Institute for Highway Safety (IIHS) published the following data from 2017:

  • A total of 4,102 people died in large truck crashes.
  • 11 percent of all motor vehicle crash deaths occurred in large truck crashes.
  • 74 percent of deaths in large truck crashes involved tractor-trailers, and 25 percent were in crashes involving single-unit-trucks.
  • 48 percent of large occupant deaths occurred in crashes in which the vehicles rolled over.

Why the State of Colorado is Dangerous for Truckers

Colorado is home to the Rocky Mountains and is part of the “Million Dollar Highway.” The Million Dollar Highway, also known as Highway 550, contains curvy trails and hazardous roads due to weather conditions. For example, weather conditions such as black ice and snow can greatly impact the roadways and result in accidents.

According to Business Insider, “For Colorado, in particular, it’s definitely the black ice and winds, and there are a lot of mountains too. It’s extremely dangerous to drive there.”

Although the Million Dollar Highway is a shortcut for countless truckers heading out West, it does not come without potential danger.

Top Reasons for Trucking Accidents

Truck Driver Texting While Driving An 18-wheeler

Tractor-trailer wrecks occur for numerous reasons, however, they can all lead to severe damage and life-altering injuries. Some of the most frequent causes of trucking collisions include the following:

  • Driving fatigued – Truckers drive extended hours which can cause fatigue if they don’t take time to rest. Since drivers typically have a deadline to meet, they will often skip necessary rest breaks to ensure they reach their destination by the required time. When a trucker drives without adequate rest, it can cause a lack of concentration and slower reaction time.
  • Lack of training – In some cases, a driver may lack the proper training to safely operate a large semi-truck.
  • Distracted driving – Since truckers spend long hours behind the wheel, some may look for ways to burn the time. This can include talking on the phone, texting, or changing the radio station. These are all common types of distracted driving that can lead to an accident.
  • Poor maintenance – Vehicle maintenance is vital to the overall safety of the driver and their truck. If maintenance checks are not frequent, it can lead to an accident. For example, incorrect tire pressure and worn parts can impact the safety of the truck and result in tragic accidents.

While trucking accidents can happen for a wide variety of reasons, it’s imperative to know how to proceed if you’re in an accident with a truck. The moments immediately following a collision can impact any potential compensation that may be available for the injuries and property damage you suffered.

Steps to Follow After a Collision

The decisions you make after a tractor-trailer accident are crucial because it can influence your claim should you choose to file. Listed below are tips you can follow if you’re involved in a wreck with a semi-truck:

  • Remain calm – It’s natural to react with shock after being involved in an accident, however, it’s essential to not allow your emotions to dictate how you will proceed.
  • Call emergency personnel – It’s in your best interest to call emergency responders after a wreck. When the responding police officer arrives, they can review the accident scene and write a report. A police report can be used as vital evidence if you choose to file a claim.
  • Ask for information – Even though the police will file a report, relevant information such as the phone number, the name of the trucking company, and the driver’s license number are essential to obtain from the other driver.
  • Gather evidence – Evidence such as photographs and witness statements can help build your accident case if you choose to file a claim.
  • Contact a knowledgeable attorney – Truck accident cases can be difficult to file without legal advice. With a knowledgeable attorney handling your case, you may increase your chances of receiving compensation for what you endured.

Know Your Legal Options

Lawyer Providing Legal Advice To A Client Privately

If you or someone you know was injured in a trucking collision, our truck accident attorneys can assist you with your legal claim. Trucking companies typically have large insurance policies in place to protect their drivers in case of a collision, however, this can make it difficult to file a claim. Additionally, these insurance companies may attempt to offer a low settlement amount, which may not cover all of your expenses. In order to determine if you are eligible to obtain compensation, an attorney will need to examine the circumstances of your case. Compensation can help cover medical bills, lost wages, and various other costs.

Our Colorado Springs truck accident lawyers can help you receive the maximum compensation for your injuries and any property damage. A Colorado Car Accident Lawyer Can Assist You with Your Legal Claim

Motor vehicle accidents can leave permanent injuries and even result in death. There were 558 fatal crashes and 608 fatalities in Colorado in 2018, according to Safer America.

Traffic laws are enforced to keep motorists safe while behind the wheel of their vehicle. However, when drivers fail to comply with the laws, it can create hazardous roadways and lead to fatal accidents. The state has faced a consistent issue with drivers failing to obey the “move over” law, implemented in 2005.

If you or a loved one sustained injuries due to an automobile accident, our Colorado car accident lawyers at Heuser & Heuser can seek justice on your behalf and help you receive the compensation you rightfully deserve. Car crashes can have a life-changing impact on the victim and their family. Our attorneys wholeheartedly believe that if you suffered injuries as a consequence of someone else’s negligent behavior, you deserve compensation for what you experienced.

What is the “Move Over” Law?

The move over law orders all motorists to change lanes or slow down when approaching any stationary emergency or maintenance vehicles with their lights flashing. This can include police, road maintenance vehicles, tow-trucks, and emergency personnel.

The law is intended to ensure the safety of those operating these types of vehicles. Yet, numerous people fail to obey the law and, instead, don’t change lanes or slow down.

If you would like to know more about what the move over law entails, click here.

Should I File a Lawsuit?

A significant amount of people don’t file lawsuits after an auto accident, because they are unsure if their case is worth pursuing. In order to determine if you have a case, it’s in your best interest to solicit legal advice.

Whether or not you are eligible to receive compensation is determined by multiple factors. For example, the severity of your injuries and the overall medical treatment necessary for recovery are evaluated to determine if you are qualified to obtain compensation.

Filing a lawsuit can be strenuous and time-consuming, however, when you contact one of our Colorado car accident lawyers, you can concentrate on recovering while we take care of the rest.

Save Lives and Move Over

Small SUV Being Towed Away Stock Photo

It’s imperative to implement safety every single time you’re behind the wheel of your vehicle. One of the ways you can help save lives is abiding by the move over law.

Our emergency responders, maintenance workers, and towers deserve to be safe while working. The next time you are approaching one of these vehicles with their lights on, make sure to change lanes. However, in some circumstances, it can be difficult to change lanes. If you’re unable to move over, slow down and pay close attention to the road.

If you are capable of moving over, change lanes and decrease your speed. Even when you shift lanes, it’s still important to drive slowly and watch your surroundings. If you obey this law, you will help protect the lives of those who serve our community.

A New Camera System Could Ticket You for Failure to Obey the Law

A new camera system created by Brekford Traffic Safety could ticket drivers who do not follow the move over law. The camera is installed on emergency vehicles and issues tickets or a warning to drivers who fail to obey the traffic law. Rod Hillman, Brekford’s president, said, “Essentially it’s a combination of radar and high-resolution cameras that identify, capture and record and transmit move over violations.”

Sources say that after colliding head-on with another vehicle, vehicle no. 1 spun into a nearby gas station parking lot, killing the passenger. The driver of the other vehicle suffered no serious injuries. According to Black, alcohol and recklessness are major factors in the case.

Jaron died at the scene.

Suffering an injury due to someone else’s careless actions can greatly impact an individual’s life. The Centers For Disease Control and Prevention (CDC) stated that there were, “92.2 million visits to physician offices for injuries in 2016.” This statistic shows that injuries happen more often than people realize.

If you or a loved one have suffered an injury from a slip and fall, automobile accident, or truck accident, our team of Pueblo personal injury lawyers is ready to fight for you.

At Heuser & Heuser, we believe in providing our clients with high-quality, compassionate service. With our dedication and determination, you can trust that your case is in capable hands.

Various Types Of Personal Injury Cases

Our law firm handles a wide variety of injury cases in order to better serve our community. Some of the cases we handle include the following:

If you’re unsure if you have a strong injury case, it’s in your best interest to seek legal guidance. In some cases, people don’t file a claim because they are unsure if they have a case, causing them to miss their chance of possibly receiving compensation.

What Can A Settlement Cover?

Medical Bills Stock Photo

A settlement or compensation amount is intended to cover the injuries and losses you’ve endured. In order to determine how much you should be awarded, multiple factors are taken into account such as the extent of your injuries, how long your recovery will take, and the treatments needed for your injuries.

Compensation can include:

If you or a loved one suffered injuries from an accident, you may be eligible to receive compensation for your injuries. Although compensation may not repair the damage that resulted from the accident, it can alleviate some of the stress and financial burden you have endured. We believe you should be able to return to your life as quickly as possible and look forward to your future despite what you have experienced.

What Are Residual Or Permanent Injuries?

A residual injury is one that has left permanent effects or done long-lasting damage, which can immensely impact the compensation you may receive. These types of injuries can include scarring, back injuries, and numerous other impairments. When you contact our law firm, we can review the extent of your injuries to see what options you may have.

If you have suffered a permanent injury, it’s vital the injury is documented in your medical records. Medical records are an imperative part of an injury claim and help determine the amount you should receive for your injuries. Additionally, it is important that the individual or company you are seeking compensation from is aware of the impact your injuries have had on your life.

If I Have Surgery, Will It Increase My Award?

In some cases, having surgery can increase your personal injury settlement amount. Although surgery can lead to a higher settlement, it should not be your main reason for undergoing any medical operation.

If surgery is necessary for your recovery, then you should have the procedure. If not, it’s better to be honest and not play the insurance system. In any surgery, you take risks such as infections, scarring, more damage, and in some cases, death. This is another reason you shouldn’t solely base your decision to have surgery around receiving higher compensation.

It’s important to allow one of our attorneys to review the details of your case to see what options may be available. In some instances, surgery can increase your settlement amount, while in others, it will not. Compensation for surgery is dependent on the circumstances of your individual case.

Red-light cameras were intended to help reduce traffic accidents around intersections and improve the overall safety of the public, but studies have proven the opposite.

Injured in An Accident Involving a Red-Light Camera? A Colorado Car Accident Lawyer Can Assist You

An article by Phys.org stated, “Touted by supporters as a way to increase public safety by ticketing drivers who continue through red lights, the cameras actually shift traffic patterns: More drivers tend to brake harder and more abruptly, increasing fender-benders and other so-called “non-angle” collisions.”

The dangers of red-light cameras can be serious and have caused an increasing amount of collisions in the United States. Our Colorado car accident lawyers at Heuser & Heuser can help you file a claim for the damages and injuries you endured in a motor vehicle accident.

Red-Light Dangers

Red-light cameras were intended to prevent drivers from running red lights. However, they have caused drivers to slam on their brakes to avoid being ticketed. This is dangerous because when a driver slams on their brakes, it can result in a chain reaction and cause multiple cars to crash. Although red-light cameras have saved lives by encouraging people not to run red lights, they have also caused injuries and property damage.

The National Center for Statistics and Analysis (NCSA) shared these alarming statistics about how serious red-light running has become:

  • 2 people died each day in red-light running crashes on average in the U.S. in 2015
  • 60 people died each month in red-light running crashes
  • 710 people died each year in red-light running crashes on average from 2011-2015

Tips After A Collision

After a car crash, the following steps are essential. Follow these tips on what to do in the moments after an accident:

  1. Check to see if anyone is injured
  2. Call emergency personnel
  3. If possible, move the vehicles over to the side of the road to prevent any further injuries
  4. Take photos of the accident from multiple angles
  5. Contact your insurance company
  6. Collect important information such as the other driver’s insurance and phone number
  7. Contact one of our attorneys to help you with your case

DMV Accident Reports

Traffic Collision Report Stock Photo

In some cases, accidents are not reported. If you have suffered damages and injuries, it can be challenging to receive compensation without an accident report. The DMV, or Department of Motor Vehicles, offers multiple resources on their website and lists these tips for filing a DMV accident report:

  • Always file a DMV accident report if the other involved driver is uninsured
  • File the report as soon as possible after the accident
  • Include as much detail as possible in your report
  • Keep a copy of the report for your own records
  • If you are not required to file a report but the police were involved, request a copy of the report filed by the police for your records

If you would like to obtain a copy of your car accident report, you can do so by going to the DMV’s website.

Ways To Avoid Red-Light Running

Red-light cameras were intended to reduce accidents but collisions continue to occur. Safety should be the number one priority while driving on the roadways but, unfortunately, not everyone obeys traffic laws. For this reason, all drivers need to take safety into their own hands and obey the laws and regulations surrounding red-lights to help prevent accidents. Listed below are ways you can help bring safety to the highways and avoid running a red light:

  • Be alert to your surroundings- It’s important to be aware of the cars around you, as well as upcoming lights that may require you to slow down or stop.
  • Know the laws for yellow lights
  • Watch your speed and obey the limit- Obeying the speed limit is vital. When you disobey the posted speed limit, it will take you longer to slow down when approaching a light.
  • Never allow yourself to drive drowsy or distracted- Distractions are a major cause of accidents. If you are distracted while driving, it could cause you to stop late or drive past the light.

Drivers should not only worry about their safety, but also the safety of others. Implementing these tips could help you and other drivers avoid running red lights. Remember, major intersections are high-risk areas for crashes, so it’s essential to be alert while driving.
