How Uber Accident Attorneys Can Help
Rideshare cases often require a close examination of insurance coverage and the driver’s status at the time of the crash. Our personal injury lawyers in Colorado Springs can examine the facts of your case and determine which claims may be available.
Here’s how we assist with your case:
- We investigate your collision to determine what happened and who may be responsible.
- As part of our investigation, we determine the Uber driver‘s status at the time of your accident.
- Our legal team also identifies the parties who may be responsible for your injuries and determines which insurance policies may apply.
- To establish the full extent of your claim, we document the full losses you experienced because of the accident.
- Throughout the claims process, you can rely on us to handle communications with the insurance companies on your behalf.
- Our team will negotiate for a fair settlement that completely covers your damages.
- If a fair settlement cannot be reached, we are prepared to pursue a lawsuit to seek full compensation.
Our contingency fee arrangement means you do not pay us attorney fees upfront. Instead, our fee comes from the settlement or award we recover for you. If our team does not recover compensation on your behalf, you do not owe attorney fees.

Filing a Lawsuit Against Uber After an Accident in Colorado
The fact that an Uber driver caused a collision does not necessarily mean that Uber is automatically liable for every resulting injury. Uber classifies its drivers as independent contractors, which can affect whether Uber may be held liable for a driver’s conduct. However, Uber may still face liability depending on the facts of the case.
Our Colorado Springs Uber accident attorneys will examine issues such as the driver’s status on the Uber platform and whether there is evidence of independent negligence by another party. This will help us understand how to pursue the correct parties for your damages.
Colorado also follows a modified comparative negligence rule. If you are found to be partly to blame, this means that damages can be reduced according to your fault. Recovery is not permitted when your negligence equals or exceeds that of the party from whom recovery is sought.

When Uber May Be Liable for an Accident
Colorado has specific rules governing transportation network companies such as Uber. The insurance available after a crash can depend on what the driver was doing through the Uber platform at the time of the collision.
The driver’s status at the time of your accident can determine how much of Uber’s insurance coverage may be available to you. When an Uber driver is logged into the app and has accepted a ride, Uber’s $1 million in primary liability coverage may apply.
A lower level of coverage applies when the driver is logged into Uber but has not yet accepted a ride. During this period, Colorado requires primary coverage with limits of at least $50,000 for one person’s injuries and $100,000 for injuries in one accident.

When the Driver May Be Responsible for a Crash
If the driver was not logged into Uber’s digital network, the rideshare-specific coverage provisions usually do not apply. Your claim will instead proceed under the driver‘s ordinary automobile insurance and other applicable sources of coverage.
There may also be additional responsible parties. For example, another motorist’s negligence may have contributed to the collision. Our Uber accident lawyers in Colorado Springs will file your claim and seek the compensation you need from all responsible parties.
