COLORADO SPRINGS, Colorado – Many people still believe there is a “two-bite rule” that applies to so-called “dangerous breeds” of dogs, but Heuser & Heuser, LLP, a personal injury law firm that’s local and here to serve its neighbors, wants the public to know these outdated assumptions no longer hold true. By law, Colorado does not label certain breeds as “dangerous.” Instead of singling out dogs based on their breed, the state’s current dog bite laws hold owners responsible for serious injuries, regardless of the dog’s background. This shift puts the focus where it belongs—on owner accountability and public safety.

Before 2004, breed-specific rules meant that some owners faced legal trouble simply because their dog fit a certain profile, even if the animal had never bitten anyone. Those days are gone. Today, if a dog attacks someone who is legally on the property and causes serious bodily harm or death, the owner can be held strictly liable for economic damages. Under these laws (C.R.S.A. § 13-21-124), it doesn’t matter if the dog is a Chihuahua, a German Shepherd, or anything in between.

There are, however, a few exceptions. Owners may not be liable if the person bitten was trespassing, provoking the dog, or if the dog was working as a hunting or herding animal at the time. Additionally, if it’s shown that the owner knew the dog was dangerous, the court may order the animal to be euthanized.
