The idea here is that, even if your vehicle is stopped, cars behind you must leave enough room to brake suddenly if need be. If they were therefore following too closely and rear-ended you, determining who hit whom is pretty standard. It also deserves to be mentioned that the driver who rear-ended you could have a potential claim to file if they hit you due to a third-party vehicle.
Left-Turn Accidents
Much like rear-end collisions, a left-turn accident is typically a pretty open-and-shut affair. Any car making a left turn must yield right of way to oncoming vehicles going straight through the intersection. Any accidents arising from a left-turn, therefore, tend to be the fault of the turning driver. In some instances, such as if the oncoming vehicle was running a red light, fault can be shifted. However, these cases are few and far between.

Sometimes proving fault can be a little trickier and if the police are involved, you will want to get the police report and use it when attempting to negotiate with insurance companies. At the very least, many insurance companies will hold off on issuing an accident liability report without first obtaining a copy and there’s little wonder why. Police reports often contain a lot of liability evidence and can make or break a personal injury case.
