How To Prove Fault After A Car Accident in Colorado Springs

Man and Woman Arguing After Car Accident Stock Photo

Getting hurt in a car accident due to someone else’s negligence is an incredibly stressful situation no matter who you are but it can get a whole lot worse when the other driver denies fault. What was a matter of physical well-being is now a legal arena, and if you want to get the compensation you deserve, you will have to prove the other driver was responsible for your injuries. Insurance companies will also want to see hard evidence backing up your claim.

In almost all scenarios, having an experienced personal injury lawyer on your side could prove the difference in getting what you deserve. Based in Colorado Springs, Heuser & Heuser has seen all sorts of car accident cases and, as such, we know what to do to prove fault in yours.

What Type Of Accident Do You Suffer?

Proving fault when you get hurt in a car accident can be a lot easier depending on the specific type of accident suffered. In fact, there are a couple types of accidents that are almost always the fault of the other driver. If you have been involved in one of these, you are probably in good shape to deal with insurance companies.

Rear-End Collisions

Probably the most common type of car accident is a rear-end collision, and it is also one of the easiest in which to prove fault. The idea here is that, even if your vehicle is stopped, cars behind you must leave enough room to brake suddenly if need be. If they were therefore following too closely and rear-ended you, determining who hit whom is pretty standard. It also deserves to be mentioned that the driver who rear-ended you could have a potential claim to file if they hit you due to a third-party vehicle.

Left-Turn Accidents

Much like rear-end collisions, a left-turn accident is typically a pretty open-and-shut affair. Any car making a left turn must yield right of way to oncoming vehicles going straight through the intersection. Any accidents arising from a left-turn, therefore, tend to be the fault of the turning driver. In some instances, such as if the oncoming vehicle was running a red light, fault can be shifted. However, these cases are few and far between.

Obtain A Police Report

Sometimes proving fault can be a little trickier and if the police are involved, you will want to get the police report and use it when attempting to negotiate with insurance companies. At the very least, many insurance companies will hold off on issuing an accident liability report without first obtaining a copy and there’s little wonder why. Police reports often contain a lot of liability evidence and can make or break a personal injury case.

Frequently Asked Questions

There are a variety of things we look at when evaluating your case and determining its value. We look at how the accident occurred. We look at what sort of injuries you sustained. Do you have a permanent injury that will last the rest of your life? Are you going to have future medical bills? We look at lost wages. Did you lose your job? If you have permanent work restrictions as a result of the accident, you may not be able to find a job very easily in the future. These are some of the factors that we look at in evaluating a claim. Every case is unique and different. That’s why at our law firm, every case gets personal attention from the lawyer when it comes time to evaluate.

Insurance companies are in business for a reason: to make money. Anytime they are paying money on a claim, it means less money to their bottom line. They have literally hundreds of adjusters and hundreds of lawyers who are on their side trying to figure out how to prevent money from leaving their checkbooks. Quite frankly, you do need a lawyer to help you through this because your lawyer will make sure you’re properly compensated.

Cases settle before going to trial 80 to 90 percent of the time. However, that doesn’t mean there’s not a lot of work involved in getting a case settled outside of court. Sometimes you have to file a lawsuit and do a lot of what I call “legal maneuvering” to get a case settled. That means we take depositions from witnesses to the accident, from police officers, and from your doctors. But, yes, most cases will settle prior to trial.

We do get good results for our clients. We have settled hundreds, if not thousands, of cases where we’ve had large settlements. We’ve had substantial verdicts. We go to the mat for our clients if necessary. We’ll appeal cases. We’ll do whatever it takes to make sure our client is taken care of.
