Do Accident Cases Settle Without Going to Court in Southern Colorado?

Yes, most personal injury cases in Colorado settle before they ever reach a courtroom. According to the U.S. Department of Justice Bureau of Justice Statistics, only about three to four percent of tort cases actually go to trial. The remaining 96 percent or so resolve through settlement, dismissal, or alternative dispute resolution. That doesn’t mean trial is avoided at all costs. It means both sides usually reach an agreement once the evidence is developed and the value of the case becomes clear.
Reaching a settlement is still a lot of work. Your attorney gathers medical records, documents your damages, investigates the accident, and often takes depositions from witnesses, police officers, and medical providers. A demand letter is sent to the at-fault party’s insurance company laying out the claim, and the insurance company responds, usually with a lower counteroffer. From there, negotiation continues back and forth until both sides agree on a number, or until it becomes clear that settling is not going to work.
One thing we want every injured client to know: never accept a settlement offer without talking to an attorney first. Insurance adjusters know how to make a low offer sound fair, and once you sign a release, you cannot go back for more even if your injuries turn out to be worse than you thought.
